北京务实知识产权发展中心简介(Introduction of BIPI)

北京务实知识产权发展中心是经北京市知识产权局、北京市民政局批准,于2005年12月成立的一家民办非营利机构。

中心的建立旨在为从事专利、商标、版权、商业秘密、外观设计、植物新品种、集成电路布图设计等知识产权相关工作的人士提供一个学术研究和信息 交流的平台。发挥各方知识产权专家、学者的学术研究专长,接受各级政府、组织、行业协会和企业的专项委托,开展知识产权实务研究工作,发布知识产权保护相 关信息。通过高质量的、独立的研究和信息发布,推动全社会对知识产权法的认识和理解,促进我国知识产权保护事业的发展,对社会的经济发展与繁荣做出贡献。

中心除拥有专门的研究人员外,还聘请了一批长期从事知识产权工作、有丰富知识产权工作经验的官员、学者、律师、代理人及企业管理人员,利用业余时间开展研究工作,发表研究成果,共享相关信息。

中心注重实务方面的研究,着力解决知识产权保护中遇到的实际问题,研究成果为法律、政策的制订和决策者,为企业管理者提供决策参考。

中心的经费主要来源于会员出资、课题经费及基金资助。

中心宗旨:务实、独立、共享

业务范围:

1、 独立开展知识产权热点、难点问题实务研究;
2、 接受政府、企业、事业单位、行业协会等委托,进行知识产权战略与策略及相关专项课题研究;
3、 进行知识产权侵权专题分析、论证、咨询,出具法律意见书;
4、 组织开展知识产权专题论坛、讲座、研讨及培训;
5、 为解决纠纷进行策略分析,出谋划策,指导知识产权诉讼;
6、 应当事人的请求协调解决知识产权争议;
7、 组织编写出版知识产权实务刊物、书籍;
8、 开展民间知识产权国际交流、培训。

Beijing Intellectual Property Institute

The Beijing Intellectual Property Institute (BIPI), a non-governmental IP research organization, was established in December 2005 with the approval and authorization of the Beijing Intellectual Property Office and Beijing Civil Affairs Bureau.

BIPI carries out intellectual property research and facilitates the exchange of related information for those who are concerned about patents, trademarks, copyrights, trade secrets, designs, new varieties of plants, and lay-out designs of integrated circuits.

Making full use of many distinguished intellectual property experts’ and scholars’ expertise, BIPI carries out case studies on specific intellectual property issues on behalf of various levels of government, institutions, trade associations, and enterprises, compiling and disseminating information on intellectual property protection.

By conducting and disseminating independent and high quality research, BIPI aims at increasing society’s awareness and comprehension of intellectual property law, enhancing the progression of intellectual property protection in China and thus contributing to overall social and economic development and prosperity.

BIPI, in addition to its own researchers, retains experienced IP-related government officials, scholars, attorneys, and administrative personnel as part-timers researchers. These researchers benefit from their findings while at the same time providing up to date information.

BIPI’s research concentrates on solving practical issues emerging in the field of intellectual property protection. Research findings and achievements may serve as reference for law or policy makers as well as for private enterprise decision makers.


BIPI is mainly funded by membership fees, research projects, and donations.

Director of Beijing Intellectual Property Institute

Director CHENG Yongshun was a Senior Judge and the Deputy Presiding Judge of the IP Division of Beijing High People’s Court.

He was a pioneering judge who handled many influential intellectual property trials. He was nominated one of the 50 most important IP figures of the world (and one of the three most important IP figures in China) by the publication Managing Intellectual Property in July/August, 2003.

He has authored and co-authored many books throughout his judicial career. Among his publications Patent Litigation (1993) was the first book concerning the judicial protection of patent rights in China. It has had great influence on judges and attorneys, as well as in academic circles. Patent Infringement Establishment(co-author, 1998), comparing Chinese patent law and practice with that of the United States, was awarded second prize for “outstanding contributions in the field of philosophy and social science in Beijing”. The book has also been published in Japan. His newest work, China Patent Litigation (2005), is an indispensable reference book for both judges and attorneys.

He has presided and participated in many national research projects and has published many articles and case comments. He has received many awards for both his academic and practical contributions to the IP world.

He serves as the Executive Director of the China Intellectual Property Institute; Executive Director of the China Trademark Association; Deputy Secretary-General and Executive Director of the China Science and Technology Law Institute; Executive Director of the Intellectual Property Institute of the China Law Institute; Member of the Panel of Neutrals of the Domain Name Dispute Resolution Center; Visiting Professor of the National Judges College; Visiting Associate Professor of the Law School of Renmin University; Part-time Senior Lecturer of the Training Center of the

General Administration Office for Industry and Commerce of PRC; Part-time Tutor to the Law School of Peking University’s postgraduate program.

Services

 To generate an independent and authoritative collection of objective research on complex, current issues in intellectual property;
 To conduct research on intellectual property issues or on intellectual property strategy on behalf of governments, institutions, enterprises, and trade associations;
 To advise on specific intellectual property disputes and to provide legal opinion;
 To advise and formulate strategies for parties in disputes;
 Upon the request of clients, negotiating settlements in intellectual property disputes;
 In all intellectual property matters, to act as a consultant for government departments, public institutions, and industry interests;
 To organize seminars, workshops, and training programs on intellectual property issues;
 To compile and publish materials on intellectual property issues;
 To organize an international exchange and training program on intellectual property issues.
